Terms of Use
These terms are the agreement between you and Data Dolphin for using ShadowJab: this website, the browser game, and the ShadowJab apps for iPhone and Android, including subscriptions and other in-app purchases. By using ShadowJab, you agree to them.
How we handle your data is explained in the Privacy Policy.
The short version
- Box safely. Clear the space around you, stop if anything hurts, and check with a doctor first if you have any health concerns. ShadowJab is a game, not medical advice.
- The browser game is free. The apps are free to download, with ads and a limited number of free rounds.
- ShadowJab Pro is an optional subscription. It renews automatically until you cancel it in your App Store or Google Play account, at least 24 hours before the current period ends.
- Apple or Google handles payments and refunds.
- Your legal rights as a consumer always apply. Nothing in these terms takes them away.
This summary is here for convenience. The full terms below are what apply.
1. Who we are
ShadowJab is provided by Data Dolphin ("we", "us"):
Data DolphinOwner's full name, or the registered company name
Street, postcode, city, country
Email: support@datadolphin.net
Send any question, complaint or claim about ShadowJab to us there.
2. Who can use ShadowJab
You must be at least 13 years old to use ShadowJab. If you are under 18, or under the age of majority where you live, you may only use it with the permission of a parent or legal guardian, who agrees to these terms for you and is responsible for any purchases. You do not need an account.
3. Health and safety
ShadowJab is a physical workout. You will punch, lean, step sideways and duck at speed, sometimes for several minutes at a time.
- Check with a doctor first if you have a heart condition, high blood pressure, joint, back or neck problems, or any other health condition, if you are pregnant, if you have recently been ill, injured or had surgery, or if you are not used to exercise.
- Clear the space. Move furniture, lamps, glass, pets, other people and anything else you could hit or trip over. Make sure there is room above your head and to both sides, and that the floor is not slippery.
- Set your device down securely, on a stable surface where neither you nor anyone else can knock it over.
- Warm up and know your limits. Stop at once if you feel pain, dizziness, faintness, shortness of breath or chest discomfort, and get medical help if you need it.
- Flashing images. The game uses flashes and fast-moving shapes. If you have ever had a seizure or epilepsy, talk to a doctor before playing, and stop immediately if you feel unwell.
- Under 18? Play with an adult nearby. And nobody should play after drinking alcohol or while unwell.
ShadowJab is a game and a training aid. It is not a medical device and gives no medical or professional training advice. Scores, speed, power, ranks and other figures are estimates the game works out from the camera picture. They are not exact measurements and should not be used to make decisions about your health. You are responsible for choosing a safe place to play and for exercising within your limits. Our liability is explained in section 11.
4. Your licence
ShadowJab belongs to us or our licensors: the software, the game design, the artwork, the sounds and the text. We give you a personal, non-exclusive, non-transferable licence, which we can withdraw if you break these terms, to use the website and the browser game, and to install and use the apps on devices you own or control, for your own private, non-commercial use. If you got an app from the App Store or Google Play, that store's usage rules apply too. We license ShadowJab to you; we do not sell it to you.
ShadowJab includes open-source software, such as Google MediaPipe and Flutter, which is licensed under its own terms. Nothing in these terms limits your rights under those licences.
5. Rules
When you use ShadowJab, you must not:
- copy, modify, distribute, sell, rent or sublicense ShadowJab or any part of it, except where these terms or the law allow it;
- decompile, reverse engineer or disassemble the apps, except to the extent the law allows it despite this rule;
- get around ads, the free-round limit, purchases or other technical limits, or unlock paid features without paying for them;
- generate fake ad views or clicks, or otherwise interfere with ads;
- interfere with or disrupt ShadowJab, our servers or our partners' services;
- use ShadowJab for anything unlawful.
If you seriously or repeatedly break these rules, we may end your access (section 12).
6. Free version, ads and rewards
- The browser game is free and has no ads.
- The apps are free to download. The free version includes a limited number of free rounds, which refill over time, and shows ads. The details, such as how many rounds you get and how often they refill, are shown in the app and may change.
- Some ads offer a reward, such as an extra round, for watching them to the end. The reward is given once our ad partner confirms that the ad was watched. If no ad is available, we cannot give the reward.
- Free rounds, rewards and other in-app items have no cash value, and cannot be exchanged for money, transferred or sold. They may expire as described in the app.
- Ads are supplied by third parties. We do not control what they advertise, but please tell us if you see an ad that seems inappropriate. How ads use your data is explained in the Privacy Policy.
7. Subscriptions and in-app purchases
ShadowJab Pro
ShadowJab Pro is an optional subscription that removes ads and unlocks more, such as unlimited rounds and every round length. What it includes, its price, its billing period and any free trial are shown in the app before you buy. We may also offer other in-app purchases.
Buying through Apple or Google
Purchases are made through the App Store or Google Play and charged to the payment method in your Apple or Google account. The store's terms apply to the purchase as well as these terms. The price, including any tax the store adds where you live, is shown before you confirm.
Automatic renewal
A subscription renews automatically at the end of each period, for example each year, for the same length of time and at the price that applies then, unless you cancel it. Your account is charged for the renewal within the 24 hours before the current period ends. To avoid being charged, cancel at least 24 hours before the end of the current period.
Free trials
If a free trial is offered, its length and the price that applies after it are shown before you start. Unless you cancel at least 24 hours before the trial ends, it turns into a paid subscription and you are charged. A free trial is available once per Apple ID or Google account, as the store decides. On the App Store, any unused part of a free trial ends when you buy a subscription.
Managing and cancelling
You can see, change and cancel your subscription at any time in your store account:
- on iPhone, in Settings › your name › Subscriptions;
- on Android, in the Google Play app: tap your profile picture, then Payments & subscriptions › Subscriptions.
Deleting the app does not cancel a subscription. When you cancel, you keep Pro until the end of the period you have paid for, and you are not charged again.
Price changes
We may change the price of a subscription. Apple or Google will tell you before a new price applies and, where the store's rules or the law require it, ask you to agree. If you do not agree, your subscription ends at the end of the current period.
Refunds
Payments are made to Apple or Google, so refunds are handled by them, under their refund policies: for the App Store at reportaproblem.apple.com, and for Google Play through your Google Play order history. For Google Play purchases you can also contact us.
Your right of withdrawal
If you are a consumer in the EU or the UK, you may have a legal right to withdraw from a purchase of digital content or a digital service within 14 days. Because purchases are made through Apple or Google, they handle withdrawals under their terms. If you ask for a subscription or other digital content to start straight away, your right of withdrawal may end or be reduced once it has started, as the law allows and as the store explains when you buy.
Restoring purchases
Purchases belong to the Apple ID or Google account you used. To use Pro on another device with the same account, tap Restore purchase in the app's settings. Purchases do not carry over between iPhone and Android.
Changes to Pro
We keep developing ShadowJab and may add, change or remove features of Pro. If a change would substantially reduce what an active paid subscription includes, we will tell you in advance and you can cancel. Where the law gives you the right, you can then also end the subscription early and get a refund for the time you can no longer use.
8. Updates and availability
- We may update ShadowJab to fix problems, improve it, keep it secure or comply with the law, and some updates may be needed to keep using it. We provide the updates the law requires to keep ShadowJab working as described.
- Camera tracking depends on your device, its camera, the light and the room, and will not work perfectly everywhere. The requirements are shown in the app stores and on the website.
- We may change or stop free features, including the browser game, at any time. Paid features are covered by section 7.
- We work to keep ShadowJab running, but cannot promise that it will always be available or free of errors, and parts of it rely on services we do not control, such as the app stores and our ad partner.
- Your scores and history are stored only on your device. If you delete the app, clear your browser's data or lose your device, they are gone, and we cannot restore them.
9. Our rights in ShadowJab
ShadowJab, its name and logo, and everything in it are protected by copyright, trademark and other laws. These terms give you no rights to them beyond the licence in section 4. If you send us ideas or feedback, we may use them freely, without any obligation to you.
Apple, iPhone and App Store are trademarks of Apple Inc., registered in the US and other countries. Google Play and Android are trademarks of Google LLC.
10. Warranty
If you are a consumer, you have legal rights if ShadowJab, or something you paid for, is not as described or does not work properly, and nothing in these terms limits those rights. Beyond them, and as far as the law allows, ShadowJab is provided "as is" and "as available". In particular, we do not promise that tracking, scores or other figures will be accurate, or that ShadowJab will help you reach any particular fitness goal.
11. Liability
- We are liable without limit for damage we cause intentionally or through gross negligence, for injury to life, body or health caused by our fault, under product liability law, under any guarantee we have given, and in every other case where the law does not allow liability to be limited.
- For damage caused by slight negligence, we are liable only if we breach an essential obligation under these terms, meaning one that makes it possible to provide ShadowJab properly in the first place and on which you can normally rely, and then only for the damage that was foreseeable and typical when you started using ShadowJab.
- Otherwise, we are not liable.
- These limits also apply to the people who work for us and with us.
12. Ending these terms
You can stop using ShadowJab at any time by uninstalling the apps and no longer using the website. If you have a subscription, cancel it as described in section 7 as well, because uninstalling does not cancel it.
We may suspend or end your access to ShadowJab if you seriously or repeatedly break these terms, or if the law requires it. If we stop offering ShadowJab or a paid feature altogether, we will give you reasonable notice where we can, and paid subscriptions will not renew after that. Sections that by their nature should continue, such as sections 9, 11 and 14, continue to apply after these terms end.
13. Changes to these terms
We may change these terms for a valid reason, such as new features, changes in the law or the requirements of the app stores, and the date at the top shows when they last changed. We will tell you about material changes in the app or on the website before they take effect. If you keep using ShadowJab after that, the new terms apply; if you do not agree to them, you can stop using ShadowJab and cancel your subscription. Changes do not apply to a period you have already paid for, unless the law requires them or they only benefit you.
14. Governing law and disputes
These terms are governed by the law of country where Data Dolphin is based, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live, and you can bring a claim in the courts there.
If you have a problem, please contact us first; most things can be sorted out by email. We are not obliged, and not willing, to take part in dispute resolution proceedings before a consumer arbitration board.
15. App Store terms
If you got the app from Apple's App Store, the following also applies:
- These terms are between you and us only, not Apple. We, not Apple, are solely responsible for the app and its content.
- Your licence to the app is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may also be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
- Apple has no obligation whatsoever to provide any maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are, as between Apple and us, our responsibility, as set out in these terms.
- Apple is not responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the app, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country that is subject to a US Government embargo or that the US Government has designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
- Questions, complaints and claims about the app go to us, at the address in section 1.
- You must comply with any third-party terms that apply when you use the app, such as your mobile data contract.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
16. Google Play terms
If you got the app from Google Play, the Google Play Terms of Service also apply to your use of Google Play and to purchases made through it. These terms are between you and us; Google is not responsible for the app.
17. General
- These terms, together with the Privacy Policy and, for purchases, the store's terms, are the whole agreement between you and us about ShadowJab.
- If a court finds part of these terms invalid, the rest stays in force.
- If we do not enforce a right straight away, we can still enforce it later.
- We may transfer our rights and obligations under these terms to another organisation, for example if ShadowJab is sold. We will tell you, and your rights under these terms will not be reduced. You may not transfer your rights to anyone else without our agreement.
- These terms are written in English. If we provide a translation and the two differ, the English version applies, unless the law where you live says otherwise.
